These lines bother me most from his e-bay description:

"I have decided to sell the masters off with resale rights so that someone else can pick them right up and put them into production. Of course, the great thing about sculpting and mold making is that once you have the master and the mold, you can sell the castings over and over again. Custom work compatible with Dwarven Forge can fetch a nice price on eBay, so if you want to get in on the action, here is ready-made product line for you to run with."

And,

"So if you are interesting in having a product to develop and sell..."



Put them into production?

Ready made product line?

A product to develop and sell?

Not cool!!!

My view:

The quality of the catacombs is dubious. Just look closely at the floors and see that they are wavey. Also, the walls don't line up. The set lacks Stefan's quality sculpting.

I'd actually be more offended that the sculptor of that catacomb set actually compared it to the grand quality of DF than I would from potential compettion from this catacomb junk.

I could sculpt up better floor tiles than that.

If this guy can rip off DF then why not rip off the one or two modest ideas this guy has and beat him to the production punch with ROTA2?

Competition is competition and now that un trademarked images are spread around, DF can move something high quality to market much faster than someone casting this from his basement.

Obviously the seller is targeting Germany, possibly over the high DF shipping costs. Perhaps DF could work a deal out with an EU distributor to reduce shipping and import costs thereby stomping out the competition. Partner up with Otherworlds and you would resolve the shipping/import issue while keeping ""competing"" products from forming up in the EU.

(note: I don't live in the EU and have no vested interest with Otherworlds other than as an admirer of great quality sculpted minis)

As a side note: because the concepts were displayed and developed on a Dwarven Forge owned site with input from this community (see the thread link mentioned above), I question if the seller actually owns an exclusivity rights to the product. Couldn't DF contest the IP in court and contact Ebay to pull the listing based upon the seller having developed the product on this site?

no offense meant, but i don't really think that this will
in any way effect DF.

Even if someone buys this and puts the parts intoproduction,
they would only be a new variant in the mix (like Hirst arts,
Ainsty and others).

The two main reasons to choose DF remain:
- prepainted
- sturdy resin (until now i've seem no equal quality product)

And another thing to think about remains:
Even if this set would be offered by DF, i think its too special.
I see that with my DoE, it doesn't get as much action as the
other sets. Its simply too special (but it mostly comes out as
evil endbosses Lair or such).

The crypt stuff is too much Necromancer or Undead style and if i
would own it it would become old fairly short if you run every
adventure with undead in it.
In solution, if DF sells if i would only get one to have all they produce,
if offered by another company i have no real interest in it.

Thanks for all your postings and support everyone:)

I promise that the next "dungeon set" (after the Advanced builder 2) will include some sort of Catacomb stuff...perhaps tied in with some all out gothic/ Abbey type theme eh? A perfect setting for Ghouls, Gargoyles, Werewolves, Lich's, etc....

Just as a note. It is an auction in the US. With it also being cross listed in Germany and Else where.

He didn't target Germany.

He targeted who ever would buy it.

Not that matters. :)

Now just a few more "ducks" need to line up so I can place my pre-order of RoTA.

Which reminds me I need to check and make sure it isn't selling out yet. Other wise might have to sell my car first. :O) Or kid into slaverrrrrryyy.

Well I guess that is a great way to squish any competitors cause if they/he had not put Dwarven Forge in the auction somewhere it would have never appeared in my search. If I search for Terrain alllll kinds of stuff pops up. I know folks have a right to protect what is there " and not that it matters one I iota " but that does not sit well with me on some level at least. I have to admit never being a big fan of our bloated bureaucratic legal system though. Ignorance it no excuse.

A - I really think DF should protect their trademark. Post a statement saying what is (resale of actual product, modified pieces, custom pieces, whatever) condoned and what is not (production runs over X sets, masters for production of competing merchandise, etc.) condoned. Then watch for violations of that statement and ask the webmasters to change to the offending text. If DF fails to protect their trademark in all cases, then when they actually do have a critical situation on their hands they may find themselves on less solid ground.

B - Possibly the best answer to a potential competitor who produces something that DF hasn't got around to yet is to go ahead with the plan and blow the competitor's product out of the water (artistically speaking, of course). Environments such as catacombs cannot be trademarked or copyrighted. The competitor cannot claim that the DF product is a rip-off unless DF's design is too close to the competitor's, and it almost can't be unless the competitor's design was so close to DF's that DF can sue them.
