Do as you wish, I'm not the one who will stop you. I just point you that Bruce says you can't sell unassembled and/or unpainted pieces made from HA bricks without a license.

I was trying to help you not getting in trouble....

Well, thank you for trying to help, and I'm sorry if I overreacted. I just felt, as I said, that the matter had already been raised and discussed, so your post seemed like a superfluous reminder of points already made, and hence felt a bit like bullying to me.

Not to butt in here, but i think i see where the confusion is from.

What i think people are reacting to is the bit in the green.
"This says that hobbyists can build and sell finished models made from my pieces. No one is allowed to sell molds made from my pieces.
However, if you sell over $1,000 worth of models in a year, then you need a license agreement to do it legally. All business must have a license agreement no matter how much they sell. Making and selling building kits which use the blocks falls under the catagory of being a business."

It seems to say you can sell Finsihed models, and you are not allowed tos ell MOLDS made from his pieces, but if you sell kits you need a license.
What i think is happening is people are seeing these as "kits" like the places that sell large cast amounts of bits that are unpainted that i have seen on the web, those places cuase they are selling kits fall under the license need.

But that's in the Green non legal section, L is looking at the legal section and saying i'm under 1K, i'm not making molds, so i should be set. I would tend to agree with him cause i don't see these as Kits.
There is actually nothing specifically saying you can't sell unpainted that i can find, the closest thing is the mention of " Finished" is the closest thing to painted, and it's in the Notes, which isn't the legal stuff.

But then the issue comes into are these Kits or not, "a set of materials or parts from which something can be assembled", if the auctions are for unpainted but assembled bits it should be fine, as it woudln't fall under the kit, and it is techinally "finished" adjective
1. (of materials or goods) brought to the desired final state; "a finished product" [ant: unfinished] They are put together but not painted...

I really find it hard to beleive that people are arguing this topic so extensively here. If the HA dude wants to complain, then let him, otherwise WTF?

For the record, I've written to Bruce to explain the situation, and if he wants me to pull the auction of unpainted pieces, I'll gladly do so. I still think I'm not doing anything wrong, but I also recognize that Bruce Hirst is the only one whose opinion matters in this regard.

Yes -- Bruce wrote back to me, asked me to throw a quick coat on the pieces. Unpainted is a no-no.

What was throwing me off was the use of the word "kit." That, to me, implies "assembly." I don't think of my Reaper minis as "kits," though I have to paint them. A completed structure that simply requires painting doesn't seem like it should be called a "kit" to me.

But Bruce can use whatever language he wants. But yes, for the record, no unpainted.

Still, crioux, nothing stops you from selling painted roof pieces. Just not $1000 worth.

Hey L and Crioux,

Here's a thought ... rather than just painting, why not tint your casting plaster as well ? Similar to the way the newer DF kits use a colored resin so a random chip isn't compounded by glaring white resin ...

Oh, and sign me up for some roofs as well, Crioux !!

I thought about that -- what counts as "painted" and "unpainted." (can you tell I'm a professional philosopher about to start law school?)

But in the end, I didn't want to try to pull anything, so I'm not going to take that approach. Still, for roof pieces it may be a lot more legitimate. Red clay tiles.... how distinguishable would that be from pieces cast in reddish plaster?

It's a thought...
