HA cavern accessories now for sale 7 Years, 5 Months ago  
I don't know if this is tacky or legal, but since people sometimes flag auctions here (like Tony Griffon's Sci-Fi sets), I figured it would be okay.

anyhoo, I'm selling some unpainted HA cavern rocks, if anyone's interested. Only one set up now, but if they sell, I'll put up another. And eventually, when I have time to paint some, I'll put some painted ones up for sale as well.

To be less tacky, I won't put the link directly. Just check out eBay, hunt for "Dwarven Forge" and "Caverns," it should show up.

Be careful, if you read the legal text on HA, you can't sell unpainted, unassembled bricks without an agreement. Even fully assembled and painted, there are restrictions, and there is a limit to the number you can sell.

Thanks for the heads-up -- but the stuff I put up is assembled, just unpainted. It is only a very small number of bricks, and I did mention Hirst Arts. I certainly wasn't TRYING to be deceptive -- if anyone objects or Bruce contacts me, I'll gladly pull the auction. And just to be safe, I won't list any other unpainted sets. (I have seen a lot of unpainted HA stuff for sale before, which is why I thought it was fine -- I haven't looked at the fine print on selling HA for several years, and I really didn't think there was a problem with selling anything other than molds themselves, as long as you mentioned Bruce)

Just checked out the fine print, and I am pretty sure I'm fine. The two rules seem to be: 1) don't sell the molds themselves, 2) don't sell so much product, or present yourself as a retailer, so that you constitute a business, without a legal agreement from Bruce.

Since I'm selling a grand total of maybe $30 worth of stuff, if it all sells for above the minimum bid, I am not stepping on any toes here. And I did credit Hirst Arts, like I said -- that to me is always the most important part -- let people know they can do this stuff themselves if they want, and send 'em to Bruce if that's their choice.

Oh, and I've listed the first painted set now, as well. There's a Buy it Now option on that one, so you don't have to wait for the full week if you don't want to.

I'm no lawyer, but the thing you might want to consider/watch out for is the use of "Dwarven Forge" in your listing... that's their IP and you have to be careful so as not to deceive buyers in any way into thinking that they're getting an official Dwarven Forge product. I think you can't use proper (trademarked) names in your title unless you're selling that particular brand.

You can use the name in your product description such as, "Is compatible with (insert name here)...".

Also, there's the business courtesy and etiquette to ask Stefan and Jeff for permission to announce here before you actually do it. Never take another poster's actions as the benchmark for your own (including my "non" legal advice!). ;-}~

You can't ignore the legal text from Hirst Arts, and wait for him to call you if it is not correct.

You can only sell fully assembled AND painted pieces. And only up to a total 1000$, after that you can't sell until you get an agreement with HA.

If not for this I would have sell a lot of Modular roofs, unpainted.

I understand -- to be honest, I am not crazy about your tone. These points have already been brought up, and I've already responded to them. I'm not sure why you are starting things up again.

Why say "You can't ignore the legal text from Hirst Arts"?

Did I ever say I was?

In fact, I specifically said I went over it, and didn't see a problem with what I'm doing.

This is the rule:

"Individuals may sell limited quantities of our products and copies of our products without the need for a license agreement as long as their total gross sale of product does not exceed $1,000.00 within any one year period."

Limited copies of products without a license for under $1000. I sold two sets for $15 and one unpainted set is up for FIVE DOLLARS. That's $20 total.

Bruce himself says:

A good rule of thumb to follow here is "if you give the impression of being a business - then I consider you to be a business". This includes anyone that acts under a business name or has an online shopping cart. I want my average customers to easily sell their old models, but I also want to control how businesses use my blocks.


That is clearly NOT applying to me. I sell a very small amount of stuff, I originally got the molds and made the pieces for myself and only decided to sell them becaues people seemed interested in having them, not because I was setting myself up as a business.

Really, that's the last I'm gonna say about this. It's DF's forum, and we've talked far more than we need to about the legal issues involving another company. I did one small thing, complying with the requests made by Bruce Hirst, and I never implied that I was being cavalier or deceitful in the way I handled the situation.

I hope I'm not coming across as rude here, though I'm perfectly happy to admit I'm defensive. I tried to make sure I was doing everything properly, and after the discussion had concluded, you came along and treated me as though I was doing things in some underhanded manner. I really don't want to talk about this any longer -- as far as I'm concerned, anyone still under the delusion that I've been unethical here is deliberately misreading me.

I'm simply not violating his rules. End of discussion.

maybe we should drop the topic. It's now the second time that I scrapped my own thoughts as I feel instead of helping they might just inflame the discussion.

Just mull over the problem of selling clear resin pieces as ice substitute. They are 'unpainted' by design.
