All,

It is nice to see that we are all passionate about our Hobby. I think the real reason that we are so focused on the reaper release is that we are waiting until April 1st to get the new stuff from Jeff and Stefan. We are trying to fill in the void. Roughly 23 days until I can open a box. Oh the pain and agony. How many times can I inventory what I own now and setup figures in outrageous configurations. All Figures, Reaper, Ral Partha, DDM, etc. If only I had those new sets from DF to come up with new and twisted scenarios to introduce both my new minis and old school paint chipped metal figs. What am I going to do for the next [check watch] 558 hours and 31 minutes. AAAHHHH!!!!!! I can not stand it. I am going to put my wotc colossal red dragon against my entire line of old school ral partha dragons. (black, red, blue) and let them battle it out in an old school battle royal in the CAVE OF DOOM. (df created cave of course) Who will win? Who cares as long as I have fun. [looking at watch] Look 558 hours and 30 minutes to go. Time is flying by.

Heh -- I'm glad I'm not the only one looking at a calendar -- two and a half weeks from April 1! Let the countdown begin!

As for the DF example -- don't forget Mage Knight Dungeons had a 3-D dungeon line that was kinda cute and cheap, a plastic set of walls and floors that could be locked together. It had a neat amount of detail, it was painted well enough, it was sturdy enough. Thin, plastic, not NEARLY as cool as DF, but certainly an adequate, very cheap alternative.

But it died, died, died. Granted, MK was already on the wane then, and the failure of other expansions to it (the siege and castle stuff, for example) was unhealthy for everything in the brand, but I think the 3-D dungeon tiles would have failed anyway. People would rather pay for a higher quality of product.

I just want to add..... Ehhhhh, well most of this is way over my head but as someone with 800 posts I just wanted to type something. I will definitely have a good look at the Reaper mini's when they come out. I can't help but think that I would like some of their really cool larger monsters " not particularly huge " and not especially orks skeletons and that sort of common stuff you can get anywhere. They put out some very uniquely cool mini's. I hope at least some of them that are prepainted will be that also.

I guess that's what i am worried about the first set is, mostly stuff you can get any where, the orcs and skeletons. The stuff i am interested in hasn't been mentioned by reaper. I want the Demons, Devils, Eye Tyrants, and odd monsters, not the general stuff.

That's the far more interesting debate, to me. What is WOTC going to do if Reaper tries to do their "eye tyrant" monster? Will WOTC be as forgiving as they have been with the metals, or will the lawyers give Reaper grief if they come anywhere near D&D iconic creatures?

eheh, i actually wrote a big thing about this over on the Reaper board.
I don't think it will directly hurt DDM sales, it might effect the secondary market by lowering costs there as the demand goes down, which will make gamers happy to get the Official minis cheaper. It may even help by driving scalpers and speculators out of buying loads and loads of cases to get the Rares to resell at a mark, getting them out of buying cases can free up boosters to be bought by people who like to buy the lines now but not at the higher prices.
The up shot is i think of possibly nothing, to maybe even helping.

If there is ANY precedent in mythology or folklore, then WotC cannot claim a copyright UNLESS their version has some unique feature that they can claim is original and exclusive to them. Additionally, if they have failed to exercise their copyright elsewhere, it weakens their ability to pursue it at all.

Take the blue dragon. Dragons cannot be copyrighted, as they are common in mythology and belong in public domain. A blue dragon is not unheard of in other media, so that can't be enforced either. The weird bone spur in the middle of its face, however, very likely belongs to them and them alone, and could get other manufacturers in trouble.

As for the beholder/eye-tyrant, I don't know if there is a mythological precedent or not. But I do know that the critters have been in multiple rules systems, AND there was a miniature version of it in the movie "Big Trouble in Little China". Depending on how many instances can be found of similar creatures, a copyright may not be enforceable, especially if WotC (or the former companies) failed to file in those cases.

There's a saying in writing. "Steal from one and it's plagiarism. Steal from ten and it's research." I think that applies here as well.

I'm curious, in particular, about how the metals will affect the legal issues. Copyright only exists so long as it is defended -- a court may decide that, since WOTC ignored the "Eye tyrant," they can't claim ownership of a plastic version. At the same time, WOTC may decide that they HAVE to do something about the plastic version, simply because they'll lose the copyright if they don't.

And, actually, someone in another thread somewhere (I'm great at research, ain't I?) pointed out that, really, WOTC doesn't need to WIN a case. It doesn't even need a good argument. It just needs a lot of money and lawyers -- which it has -- to pursue the case to the point where it proves financially disasterous to Reaper. Then Reaper would have to give in or risk losing the company to legal fees. WOTC can just outspend Reaper if they really decide to be @#$@#s about it, regardless of how much merit their case has.

That's probably my real concern -- will they decide to go to the mattresses?

I hope not -- it seems like they are more interested in holding copyright over names than likenesses -- you can't say "beholder" or "rust monster," but you can make all the familiar-looking monsters you want.

Interesting that you mention the Eye Tyrant. I loved the DDM mini when
I saw it - but regarded my chances to get one as slim. I did buy 2 or 3
packs - Amazon.co.uk as I was late in the game and no FLGS to support
for me which is anywhere close and they just were the cheapest.
When I got them the boxes looked tampered with - a white sticker on the
bottom. Looked to me like opened and resealed. Wouldn't have been
surprised if someone had opened them carefully - taken out the really,
really valuable ones - and resealed all the rest. You would have to buy
loads to proof that certain monsters are never in the set.
The shock for me was that the seller was Amazon. Couldn't proof it -
but looked fishy to me.
Two month later I bought a metal figure from Reaper - which still is
unassempled and unpainted :(
I have the same problem at the moment with collecting cards for Doctor
Who for my son. I bought quite a few packs on E-Bay as it was cheaper
and locally they tended always to be sold out. The packs looked non
tempered - but I only learned later that the super rare and ultra rare
card are as an additional !! 10st card in the pack. So in 20 packs from
3 different sources I didn't got a single super or ultra rare. The
chance should be one in six.
I'm not complaining - I bought the cards cheap and super and ultra
rares are a waste in the hands of a six year old who won't tread them
with any care at all. If something like Reaper would make some of the
secondary market less lucrative I would see this as added benefit.
No complaint about someone selling the extra figures - but hunting for
the few rare ones which fetch most money - and potetially doing this by
circumwenting the odds is just unfair.

Two different things going on here, Copyright and Trademark. you can't Copyright words names etc, you can trademark them and Beholder is copyrighted, but oddly in the US Copyright database it is by a russian company for computer stuff. You can't copyright ideas, facts, titles, short phrases, slogans, or name. those get trademarks, Copyright is for literary, dramatic, musical, artistic, and other intellectual properties, whether published, or unpublished.
So a specific image of the Beholder can be copyrighted, but you can't do the name of it.

And Copyright is acutally never given away unless you expressly do so, you don't have to defend it, in the past that may have been the case to some extent but that is no longer the case, you don't ave to "Defend it or lose it" (I am no expert but i did do a good bit of research on it before i started an e-book RPG supplement a few years back and wanted to know certain legal points to cover my own butt).

Sorry, I did actually mean trademark.

Images of Hermes are generic, but the FTD (florist) symbol is trademarked.
Snow White is a character from folklore, but the specific image/costume used in the Disney film is trademarked.

In the past, copyright really was a case of defend it or lose it. "Aspirin" was a specific brand of acetecalecilic acid that was so profitable that it was used to refer to ALL brands of acetecalecilic acid, and the copyright was lost.

Today, Paramount and Disney are positively rabid about their copyrights and trademarks, to the point of staging police raids at Star Trek conventions and legally barring elementary schools from painting Disney characters in the windows.
